How to Appeal a DVLA Decision in the UK
Whether the DVLA has refused or revoked your driving licence, or you are disputing a vehicle registration decision — this guide explains the appeal process and how to make your case.
DVLA medical fitness to drive
Under the Road Traffic Act 1988 (s.92), you must notify the DVLA of any medical condition that affects your fitness to drive. The DVLA can then revoke or restrict your licence after reviewing medical evidence against their published standards. Their decisions can be wrong — you have the right to challenge.
Grounds for challenge
- —The medical evidence the DVLA relied on is inaccurate or out of date
- —Your condition is well controlled and does not impair your driving
- —The DVLA applied their medical standards incorrectly
- —Specialist evidence supporting your fitness was not considered
Evidence that helps
A letter from your GP or consultant confirming your condition is stable and does not prevent safe driving is the strongest evidence. A DVLA-approved driving assessment from a Forum of Mobility Centres provides objective proof of actual driving ability.
Do not drive while your licence is revoked — even if you believe the decision is wrong. Driving without a valid licence is a criminal offence carrying up to six months imprisonment. Challenge the decision through the proper channels first.
How to appeal
Write formally to the DVLA setting out your grounds and providing supporting evidence. If the DVLA maintains their decision, you can appeal to a Magistrates Court within 21 days. The court considers the medical evidence independently. Legal representation at court stage is optional but can help.
Vehicle registration and penalty disputes
Disputes about vehicle registration, SORN, or unlicensed vehicle penalties are handled separately from licence decisions. Write formally to the DVLA with your evidence. If unresolved, request an independent review.
Timeline
DVLA medical case reviews typically take 6-12 weeks. Complex cases requiring specialist reports can take longer.
